Schedule Agreed for Harvard v. HHS Lawsuit
BOSTON, MA, April 28, 2025 - Judge Burrough held a status conference this morning in the case of President and Fellows of Harvard College v. US Department of Health and Human Services. Both the government and Harvard agreed to go straight to summary judgement.
In addition, lawyers representing the American Association of University Professors in the related lawsuit were also in attendance, and agreed to amend their complaint so that both lawsuits could be combined into one lawsuit.
At one point, Judge Burroughs asked the lawyers for the government, "What is the government's position on whether Harvard is entitled to due process?". In response, the government lawyers indicating that their opposing motions would mostly make "threshold arguments."
Judge Burroughs stated that she wasn't a big fan of amicus briefs, "especially when both sides are represented by competent council who are likely to hit the highlights." In response, lawyers for both sides agreed to limit the overall length of amicus briefs to 80 pages.
A full schedule for when the motion for summary judgement, amicus briefs, cross motions, and reply briefs was agreed to, culminating in a hearing on the motion for summary judgement to be held on July 21, 2025.
